This Privacy Policy explains how the Ministry of Knowledge Economy, Start-ups, and Micro-Enterprises ("the Ministry", "We", "Us") collects, uses, shares, and protects personal data of users of its websites and digital platforms ("the Platform"). It is established in accordance with Law n° 18-07 of 10 June 2018 on the protection of natural persons in the processing of personal data, as amended and supplemented by Law n° 25-11 of 24 July 2025, and is supervised by the National Authority for the Protection of Personal Data (ANPDP).
Purpose and Scope
This Policy applies to any natural person who visits or uses the Ministry's websites, e-services, or digital platforms, including services made available to entrepreneurs, start-ups, and micro-enterprises. By using the Platform, you acknowledge that your personal data will be processed by the Ministry, acting as data controller, in accordance with this Policy and with Algerian law.
Definitions
- Ministry ("We", "Us", "Our") refers to the Ministry of Knowledge Economy, Start-ups, and Micro-Enterprises, Bt 46, Boulevard Mohamed V, Alger, 16000, Algeria, acting as data controller (responsable du traitement) within the meaning of Law n° 18-07.
- Personal Data means any information, regardless of its medium, relating to an identified or identifiable natural person, directly or indirectly, notably by reference to an identification number or to one or more elements specific to that person.
- Processing means any operation performed on personal data, whether automated or manual, such as collection, recording, storage, use, disclosure, or erasure.
- Account means an account created to access the Ministry's e-services.
- Usage Data means data collected automatically through use of the Platform, such as IP address, browser type, pages visited, and time spent.
- ANPDP means the National Authority for the Protection of Personal Data (Autorité Nationale de Protection des Données à caractère Personnel), the independent administrative authority responsible for supervising compliance with Law n° 18-07.
- You means the individual using the Platform.
Applicable Legal Framework
The protection of personal data is a constitutional right in Algeria, enshrined in the 2020 revision of the Constitution. The processing of personal data carried out by the Ministry is governed by Law n° 18-07 of 10 June 2018, relating to the protection of natural persons in the processing of personal data, as amended and supplemented by Law n° 25-11 of 24 July 2025. Compliance with this framework is supervised by the ANPDP.
Personal Data We Collect
While you use the Platform, We may ask you to provide certain personal data that can be used to contact or identify you, including but not limited to:
- Email address, first name and last name
- Phone number
- Address, municipality, province (wilaya), postal code
- Information relating to your enterprise, start-up, or micro-enterprise project, where relevant to a Ministry service or programme
- Usage Data, collected automatically (IP address, browser type and version, pages visited, date and time of visit, device identifiers, and other diagnostic data)
Purposes of Processing
The Ministry processes personal data for the following purposes:
- To provide, operate, and maintain the Platform and its e-services
- To manage your Account and process applications submitted through the Platform (e.g. start-up or micro-enterprise label requests, calls for applications, support programmes)
- To respond to your requests, questions, and complaints
- To comply with the Ministry's legal and regulatory obligations
- To inform you of Ministry programmes, initiatives, and calls for applications relevant to entrepreneurs and micro-enterprises, unless you have opted out of such communications
- For statistical analysis and to improve the security and functioning of the Platform
Legal Basis & Declaration to the ANPDP
As required under Law n° 18-07, the Ministry, as data controller, declares its processing operations to the ANPDP prior to their implementation. Where a processing operation is likely to present a manifest risk to the privacy or fundamental rights of data subjects, it is subject to prior authorization from the ANPDP rather than a simple declaration. Processing is carried out on the basis of your consent, the performance of a service you have requested, or compliance with a legal obligation incumbent on the Ministry.

The Platform uses cookies and similar tracking technologies to operate correctly, remember your preferences, and analyse usage. You can configure your browser to refuse cookies; however, some features of the Platform may not function properly without them.

Recipients of Personal Data
Your personal data may be shared, strictly on a need-to-know basis, with:
- Other public bodies and agencies operating under the Ministry's supervision or cooperating in the delivery of a service you have requested (for example, agencies supporting start-ups, auto-entrepreneurs, or micro-enterprises)
- Service providers acting on the Ministry's behalf (for example, hosting or technical maintenance providers), bound by confidentiality and security obligations
- Judicial or law-enforcement authorities, where required by law or in response to a valid request from a competent public authority
- Any other recipient, with your prior consent
Transfer of Data Outside Algeria
In principle, your personal data is processed and stored within Algeria. Any transfer of personal data outside Algerian territory requires the prior authorization of the ANPDP, and is only carried out where the destination country ensures a sufficient level of protection of fundamental rights, security, and confidentiality of the data, in accordance with Law n° 18-07.
Data Retention
The Ministry retains your personal data only for as long as necessary to fulfil the purposes set out in this Policy, or as required to comply with its legal and regulatory obligations, resolve disputes, and enforce its agreements. Usage Data is generally retained for a shorter period, except where retention is necessary for security or legal reasons.
Your Rights
Under Law n° 18-07, as amended, you have the following rights regarding your personal data:
- Right to information — to be informed, clearly and unambiguously, before your data is collected
- Right of access — to obtain confirmation of, and a copy of, your personal data being processed
- Right to rectification — to have inaccurate or incomplete data corrected, free of charge
- Right to erasure — to request deletion of your data, within the limits permitted by applicable law
- Right to restriction of processing — to request that processing of your data be limited, within the limits permitted by applicable law
- Right to object — to oppose the use of your data for commercial prospecting purposes
- Right to lodge a complaint with the ANPDP

Data Protection Delegate
In accordance with the obligation introduced by Law n° 25-11, the Ministry has designated a Data Protection Delegate (délégué à la protection des données personnelles), who serves as the point of contact with the ANPDP and as the contact point for the exercise of your rights described in Article 11. The Data Protection Delegate can be reached at contact@mkesm.gov.dz.
Security of Personal Data
The Ministry implements technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and the Ministry cannot guarantee absolute security.
Links to Other Websites
The Platform may contain links to websites operated by other public bodies or third parties. The Ministry has no control over, and assumes no responsibility for, the content or privacy practices of any third-party website. We advise you to review the privacy policy of every site you visit.
Amendments to this Policy
The Ministry may update this Privacy Policy from time to time. Any change will be posted on this page, with an updated "Last updated" date. We encourage you to review this Policy periodically.
